Distracted Driving In Florida
Florida has joined others states in making texting and driving a primary offense.What this means is a police officer can now pull you over for the act of texting and driving. Previously the police officer would have had to pull you over for some other driving or automobile infraction and then issued you a citation for texting while driving. The new law also prohibits you from the use of a cell phone, smart phone while in construction zones or school zones.

The New Texting Law Took Affect January 1st 2020
- A Texting While Driving Ticket Will Cost $30
- Violating The Hands Free Ordinance In A School Or Construction Zone Will Cost $60
Texting In A School Or Construction Zone:
In addition to the $60 ticket cost offenders will also have 3 points put on thier license when ticketed for violating the Florida hands free law.
What Does Hands Free Mean In Florida?
- You Can’t Be On A Call While Holding Your Phone
- You Can’t Text While In A School Or Construction Zone
- You Can’t Look At A GPS Map On Your Phone While In Either Zone
What Does Primary Offense Mean In Florida?
A primary offense means that you can be stopped for texting and driving, the officer does not have to have any other reason to stop you.

While there is no specific law regarding eating, drinking or putting on makeup while driving, a police officer who sees you commit a traffic violation while doing one of these things can pull you over and cite you for the infraction.
So if your considering eating while you drive remember this, the Centers For Disease Control (CDC) has recommended that it is very dangerous to take your eyes off of the road. If you were to look down for just 5 seconds at 55 mile per hour you would have covered the length of a football field. Any form of distraction that takes your eyes off the road falls under the heading of distracted driving. While there might not be a law forbidding you to do it common sense dictates that it’s very dangerous.
